(Oslo 5 Mars 2010) With reference to comments in the media on the operational
arrangements for banking systems, EDB wishes to clarify and correct certain
factual matters.
Information reported in the media may give the impression that EDB operates all,
or a major part, of its customers' banking systems from the Ukraine. This is
incorrect. Systems for core banking, payment services, internet banking and card
services are operated using resources located in Nordic operations centres.
Moreover, all servers and data storage units remain located in our Norwegian
data centres, which means that no data is transferred outside Norway. Any
changes to these arrangements would only be made after obtaining the necessary
agreement from our customers.
It would appear from comments in the media that the Norwegian Data Inspectorate
is uncertain whether EDB complies with the requirements of the Personal Data Act
in relation to the question of the transfer of personal data to third countries.
This question has been carefully considered by EDB's in-house attorneys, and in
addition EDB has instructed two independent external legal opinions on the
question of the company's compliance with the Personal Data Act. The internal
and external opinions reach the same conclusion, namely that EDB does not
transfer personal data to third countries, even though certain standardised
operating services processes are carried out from the Ukraine. The Data
Inspectorate expresses the same view in its report.
In addition, comments made by the Data Inspectorate may give the impression that
EDB was not willing or able to provide sufficient documentation as required by
the inspection process. EDB considers it to be absolutely essential that it
operates in accordance with its customers' requirements, the regulatory
framework set out by official bodies such as the Financial Supervisory Authority
of Norway and the Norwegian Data Inspectorate, and Norwegian legislation, in
respect of all its activities. In this respect, good collaboration with the
supervisory and regulatory authorities is of crucial importance.
In accordance with this, EDB repeatedly offered full insight and information to
the Data Inspectorate during the course of the inspection process, and we have
invited the Inspectorate to further meetings to clarify and provide further
detail on any issues that might require further clarification.
