The Administrative Court upholds the Swedish Tax Agency's decision

ICA has received a ruling from the Administrative Court related to the tax
dispute for interest deductions for the period 2004 - 2008 previously reported
in annual reports and interim reports. The Administrative Court has decided to
uphold the Swedish Tax Agency's decision to disallow ICA interest deductions of
approx. SEK 3.5 bn. The tax claim thus amounts to approx. SEK 1.2 bn. After
previous rulings, the Swedish Tax Agency has adjusted the amounts downward.
ICA will lodge an appeal against the decision with the Administrative Court of
Appeal.
On January 1, 2009, new rules came into force which restricted the possibilities
for intra-group loans. ICA's internal financing was adjusted at the time to
comply with the new legislation. The ICA Group's tax expense for 2009 amounted
to SEK 722 M, which corresponds to an effective tax rate of 31.1%.
