(firmenpresse) - LONDON, UNITED KINGDOM -- (Marketwire) -- 05/03/12 -- The Motor Insurers Bureau (MIB) is an insurance industry backed body which provides compensation for victims of road accidents caused by uninsured or untraced drivers. This can include compensation for as well as claims for other losses as a result of an accident.

The MIB was established in 1946 as a central fund and is funded by all UK insurers. Ultimately the cost falls to law abiding motorists via their premiums. The MIB is a fund of last resort which means it will only deal with claims which cannot be met by any other source.

There are two separate agreements governing the MIB scheme:

'Uninsured Drivers Agreement' and 'Untraced Drivers Agreement'

Uninsured Driver's Agreement

This agreement requires the MIB to meet a claim against a negligent but identified motorist who was driving without insurance at the time of the accident. The Agreement will deal with property damage claims including vehicle repair costs, hire charges, loss of use of a vehicle, loss of earnings and other property damage. It will also deal with personal injury claims.

However, as the fund of last resort, if you have fully comprehensive insurance and wish to make a claim for vehicle damage or related charges, the MIB will expect you to claim via your own insurers in the first instance for property damage which will leave you only able to make a personal injury claim via the MIB.

against an uninsured driver are submitted via the low value Road Traffic Accident (RTA) portal system. This is an electronic system which allows insurers and solicitors to communicate with each other and gives much tighter deadlines than normal personal injury claims to try to deal with the higher volume of RTA claims that exist.

Under this agreement, the MIB will pay your legal costs on your behalf and this type of claim can be dealt with on a 'no win no fee' basis.

Untraced Driver's Agreement





This agreement requires the MIB to compensate the victim of a 'hit and run' type of accident where the driver of another vehicle causes your accident but drives off without your being able to obtain their details.

A personal injury claim and property damage claim can be made with the same conditions as with the uninsured agreement. An excess of GBP 300.00 will apply when your claim includes property damage which can often be deducted from the damages you receive. The untraced scheme also has strict reporting requirements and the victim of a hit and run is required to report the incident to the police within 5 days or as soon as reasonably possible.

The untraced scheme does not pay all legal costs but the MIB will make a contribution towards legal costs at a set amount of GBP 500.00 plus VAT. For this reason, it is sometimes necessary for your personal injury lawyers to make a deduction from any damages you receive to cover the balance of legal costs and expenses incurred. Your personal injury lawyers will come to some sort of an arrangement with you about how these costs will be covered.

To make an untraced claim, it is necessary to complete and submit an MIB application form in order for them to investigate the matter.

In respect of both the Untraced Driver's Agreement and Uninsured Driver's Agreement, the MIB will often require access to your medical records, you to provide a witness statement or your attendance to see a medical expert. This is not unusual and your personal injury lawyers should explain everything to you at every stage.
