According to the article, the family involves a mother who is a citizen of Scotland and a father who is a citizen of the United States. The couple parented one daughter while married.

Subsequently, the father appealed the case to the United States Court of Appeals. The court dismissed the case, citing the child was by then a legal resident of Scotland. The father appealed the case a second time to the United States Supreme Court.

Upon further review, the Supreme Court elected to hear the case. The goal of the case is to resolve the disagreement found among the Unites States Circuit Courts on whether a child's country of residence will moot further legal proceedings in this country.
