New Products Corporation Goes to Court in Response to Harbor Shores' Motion to Deny Access to Documents About the Golf Course's Development

Public Hearing Is Scheduled Today in Berrien County Circuit Court

(firmenpresse) - BENTON HARBOR, MI -- (Marketwire) -- 11/13/12 -- It's been more than a year since New Products Corporation (NPC) filed a lawsuit against Harbor Shores and developers of the Harbor Shores Golf Course for allegedly taking the company's property without asking. It is now part of the 18th fairway. Attorneys for both plaintiff and defendants will appear at a public hearing today at 1:30 p.m. in the Circuit Court of Berrien County.

Presiding Judge John M. Donahue will hear NPC's response to a motion by Harbor Shores BHBT Land Development, LLC to prevent subpoenas for documents from various companies that were involved in the golf course's development. Harbor Shores is asking the Court to order that NPC not be given a single document from these companies, even though they have many documents that are relevant to the issues in this lawsuit.

"We have been stonewalled at every turn in gaining access to information and documents about the development of the Harbor Shores Golf Course," said Cheryl Miller, president and CEO of NPC, a Benton Harbor die caster. "If legal processes were followed to build the golf course and take our company's property, why all the secrecy?"

According to attorney Mark S. Demorest of Demorest Law Firm, PLLC, who represents NPC, Harbor Shores' motion to limit information includes document subpoenas to third parties although these same parties have filed no objections to the subpoenas themselves. The unanswered question is why Harbor Shores is objecting on others' behalf?

For Miller, there are also questions about lawsuits Harbor Shores filed after NPC filed its complaint in September 2011. These include Harbor Shores' counterclaim against NPC to recover the cost of so-called "improvements" that Harbor Shores made to New Products' property. The counterclaim also seeks the amount by which Harbor Shores has allegedly improved the value of the disputed property.

"If Harbor Shores acquired the property legally, why not put all of its cards on the table? Why try to block others from producing documentation?" said Miller. "If the developers of Harbor Shores are really doing the right thing, why are they playing these games? It's a beautiful golf course which is good for our community, but the way it's been developed has been anything but transparent from the start."
