Publication within the Meaning of Section 37q (2) Sentence 1 of the
Wertpapierhandelsgesetz (WpHG - German Securities Trading Act)
The German Financial Reporting Enforcement Panel (FREP) has ascertained
that the short-form financial statements of artnet AG, Berlin, as of June
30, 2012, are incorrect:
In the short-form consolidated financial statements as of June 30, 2012,
the group recorded positive earnings from operating activities of EUR 229
thousand and a loss from discontinued operations of EUR 1.374 million.
These figures include cost allocations of approximately EUR 232 thousand to
the loss from discontinued operations, although these expenses were
incurred even after the artnet Magazine division was discontinued, and
which are thus to be allocated to the earnings from continued operations.
In addition, the closure of the Paris office does not correspond with the
definition of discontinued operations. If the expenses from the Paris
office had been allocated to the divisions as in fiscal year 2011, earnings
from continued operations would have been an additional EUR 512 thousand
lower.
The incorrect disclosure of the earnings from discontinued operations is in
violation of IFRS 5.33 (a).
