Law Society Regulatory Proceedings for July 2013

The Law Society of Upper Canada regulates the lawyers and paralegals of Ontario in the public interest. The Law Society ensures that all lawyers and licensed paralegals in Ontario meet standards of learning, professional competence and professional conduct that are appropriate for the legal services provided.
As part of this mandate, the Law Society's Hearing and Appeal Panels recently heard the following matters. Hearing and Appeal Panels are responsible for determining the appropriate disposition of cases.
Gregory Philip Brant (2005) of the Town of Deseronto
Decision: The Lawyer was suspended for one month, continuing until certain conditions are met. The Lawyer must comply with specified conditions.
Licio Edward Cengarle (1973) of the City of Toronto
Decision: The Lawyer's suspension will be served commencing on September 30, 2013 or such earlier date as the Lawyer and the Law Society may agree.
Douglas Christopher Gosbee (1993) of the City of Toronto
Decision: The Lawyer was reprimanded.
Isidoro Raffaele Grossi (2001) of the City of Vaughan
Decision: The Lawyer is suspended for one month commencing August 1, 2013 and must comply with specified conditions.
Matthew Joseal Igbinosun (1998) of the City of Toronto
Decision: The stay of the October 18, 2012 decision and order of the hearing panel in LCN126/11 is extended pending the release of the appeal panel's decision.
Wayne Fitzroy Leacock (2003) of the City of Toronto
Decision: Further to the Decision and Order dated March 19, 2013, the Lawyer shall pay costs in the amount of $60,000.
John Phillip Thomas Middlebrook (1999) of the City of Toronto
Decision: The Lawyer's licence is suspended for six months. The suspension will continue indefinitely until he meets specified conditions. Further specified conditions will apply upon his re-entry into the practice of law, including a period of practising under supervision.
Michael Andrew Osborne (1981) of the City of Toronto
Decision: Further to the Order dated April 29, 2013, the appeal panel ordered that the hearing panel's costs order against the Lawyer in the amount of $7,000 is set aside and that no costs are payable by either side respecting the hearing, stay motion or appeal proper.
Jonathan Bruce Payne of the Town of Huntsville
Decision: The Paralegal Applicant's appeal from the Decision and Order dated June 13, 2012 is dismissed. If he has continued his practice as a paralegal pending his appeal, he must take immediate steps to wind it up.
Terence John Robinson (1999) of the City of Sarnia
Decision: The Lawyer's appeal from the Decision and Order dated January 24, 2013 was allowed. He was suspended for 12 months, effective June 4, 2012, with conditions to be met both prior to and after resumption of practice.
Marvin Barry Shifman (1980) of the Town of Richmond Hill
Decision: The motion for stay pending appeal is granted.
Joseph Nathan Solomon of the City of Toronto
Decision: Mr. Solomon will be granted a Class L1 licence subject to conditions to be specified.
Rosario Talarico (1982) of the City of Ottawa
Decision: The Lawyer shall be suspended for three months, starting on a date agreed to between the Society and the Lawyer.
Jennifer Georgina Ann White (2004) of the Town of Georgina
Decision: Effective immediately, the Lawyer's licence to practise law in Ontario is revoked.
Francis Peter Yungwirth (1987) of the City of Timmins
Decision: The Lawyer and Law Society both appealed from the Decision and Order of the hearing panel dated February 16, 2012. The Lawyer's appeal against penalty was dismissed. Certain of the hearing panel's findings of misconduct were upheld, while others were set aside. The hearing panel's dismissal of Particular 1 was set aside. A new hearing was ordered on specified particulars, in the discretion of the Society.
Martin Ronald Zaretsky (1978) of the City of Markham
Decision: The Lawyer was suspended for three months commencing on October 1, 2013 and must comply with specified conditions.
