The claim sought damages that would have compensated the plaintiff for losses incurred in a car accident that included medical costs, lost income and pain and suffering.
According to the court documents, the plaintiff was driving within the borders of Clark County when he was suddenly hit from behind by a vehicle that was being driven by the defendant. The plaintiff suffered severe injuries to his neck and to his back, and these injuries required ongoing treatment and oversight that included rehabilitation and medication. The court documents also stated that the defendant was arrested on suspicion of DUI after the crash.
The attorneys at Bernstein & Poisson argued in the court documents that the defendant was not only negligent in causing the car accident that led to the injuries and losses suffered by the plaintiff but that the defendant was reckless for even driving a vehicle while allegedly under the influence of alcohol. However, rather than fully litigate the matter, the two sides were able to come together and successfully negotiate a settlement.
In consideration for the settlement amount that was received, the two sides executed a confidentiality agreement. This agreement prevents anyone associated with the case from disclosing the identities of those who were involved with it and it prevents a disclosure of the sum that was paid in the settlement.
