Ivera Medical Asserts New Patent Lawsuit Against Covidien

Additional Patent Infringement Provides Basis for Second Lawsuit Against Covidien


(firmenpresse) - SAN DIEGO, CA -- (Marketwired) -- 09/24/13 -- Ivera Medical Corporation, headquartered in San Diego, CA, has filed a second suit against Covidien for patent infringement arising under the patent laws of the United States of America, 35 U.S.C. § 1, et seq. This new patent infringement suit was filed in the U.S. District Court for the Southern District of California, Case No. 3:13-cv-2244-BTM-KSC.

Ivera manufactures, markets, and sells the Curos® Disinfecting Port Protector, a device that disinfects and protects the entry port on certain types of valves used with intravenous lines. United States Patent No. 7,282,186 (the '186 patent) is entitled "Medical Implement Cleaning Device" and covers certain features of disinfecting caps for medical devices, including luer activated valves. Last week, Ivera announced a patent infringement lawsuit against Covidien involving three other Ivera patents.

This new Ivera lawsuit alleges that Covidien's Kendall™ Disinfectant Cap products infringe one or more claims of the '186 patent, and that Ivera has been damaged due to these acts of infringement by Covidien and will continue to suffer irreparable injury unless Covidien's activities are enjoined.

"This new patent infringement case against Covidien serves as continued evidence that we will strongly defend the intellectual property portfolio that we have worked hard to build," said Matt Heindel, Ivera's Vice President of Business Development. Ivera has asked the courts to permanently enjoin Covidien from further infringing on the '186 patent, require Covidien to withdraw from distributing all infringing products and to award damages adequate to compensate Ivera for the damages it has suffered as a result of Covidien's infringement.
