Federal Dismissal of Medical Marijuana Asset Forfeiture Cases

(firmenpresse) - LOS ANGELES, CA -- (Marketwired) -- 10/18/13 -- Multiple asset forfeiture cases filed by the federal government against landlords of medical marijuana dispensaries were dismissed this week. The landlords, represented by California attorney Matthew Pappas, had been fighting the government's forfeiture cases for just over a year. "This is an important step in the civil rights battle being fought by seriously ill Californians who have been recommended medical marijuana by their doctors," said Pappas. "For patients who use marijuana pursuant to state law to alleviate symptoms resulting from cancer, AIDS, and other disabilities, this helps stop actions that have inappropriately thwarted access to medication. It is a very positive step by the Justice Department and the local U.S. Attorney." Pappas had asked the local U.S. Attorney to meet with him along with Lt. Governor Gavin Newsom, former L.A.P.D. Deputy Chief Steve Downing, and a former deputy city attorney several weeks before the government announced dismissal of the cases. In one of the cases, the Virginia-based Institute for Justice had joined Pappas as associate counsel. Court documents show the dismissals are with prejudice, which means the government cannot re-file them.
