New Orleans Personal Injury Attorney, Michael Hingle, Represents Plaintiff in Stryker ShapeMatch Cutting Guide Lawsuit
(firmenpresse) - NEW ORLEANS, LA -- (Marketwired) -- 11/07/13 -- Local personal injury attorney Michael Hingle has filed one of the first lawsuits in the country concerning the Stryker ShapeMatch Cutting Guide. The Cutting Guide manufactured by Stryker Orthopaedics was recalled on April 10, 2013 as part of a Class I recall.
Cutting Guides are often used in knee surgery to help the doctor determine where to make an incision. Stryker recalled the guides when they became aware of potential issues with the guides. They found that the parameters of the manufactured cutting guides did not meet the surgeon's pre-operative planning parameters which were entered via a web-based application. When cutting parameters were manually edited to compensate for a defect in the existing software, the edits resulted in cutting guide ranges not cleared by the FDA.
This defect could result in serious adverse health consequences, including joint instability, fracture, a need for revision surgery, chronic pain and limitations on mobility.
Mr. Hingle's plaintiff, Ouita Corley, was injured by the cutting guide when it was used as part of her total knee replacement surgery. Shortly after surgery, Ms. Corley began experiencing knee discomfort, joint instability and limited mobility. Further testing revealed the knee replacement was misaligned and may need to be replaced.
On August 29, 2013, Mr. Hingle filed a lawsuit in The United States District Court for the Western District of Louisiana. The matter has been assigned to the Honorable Rebecca F.
Doherty.
In connection with filing the case, Mr. Hingle has spoken about the problem at this year's Mass Torts Made Perfect Seminar, a premier plaintiff's seminars in the nation, in Las Vegas, Nevada and has founded the Stryker Orthopaedics ShapeMatch Cutting Guide Litigation Group with The American Association for Justice. The focus of the group is to help coordinate litigation throughout the country and to share information with attorneys who have similar cases.
No stranger to complex litigation, Michael Hingle has worked on many national cases including Avandia, Zimmer Knees and Transvaginal Mesh implants. He is currently on the Steering Committee for Brilliant Blue G, a compounded medication that is leading to blindness due to fungal contamination.
