A man who was injured while riding on a four-wheeler has filed suit against his former employer, claiming that he was discriminated against and ultimately fired for his injury.
(firmenpresse) - Charleston, West Virginia – A man who was injured while riding on a four-wheeler has filed suit against his former employer, claiming that he was discriminated against and ultimately fired for his injury. Charles W. Kidd filed in the Circuit Court of Wyoming County against employer Exco Resources LLC through his attorney, Chris Heavens of Heavens Law Firm.
Kidd claims that he was working for the employer when he had an accident while riding to a well site. The accident results in injuries to his knee which he promptly reported to his employer. The supervisors allegedly told him to return home without seeing a doctor. The next day, Kidd sought medical treatment on his own and learned he had a damaged ACL. He initiated a workers’ compensation claim and returned to work with a leg brace and while using crutches. His doctor ordered him on light duty.
Kidd was informed by the employer that he had experienced three work-related accidents within 12 months and was therefore terminated. He claims that this was untrue and that the other, minor incidents occurred more than twelve months prior to this accident. He claims that he was terminated for unlawful reasons and due to discrimination. He is seeking lost wages and benefits as well as other damages.
