Attorney Joseph Cavallo's Expert Opinion on New York's Criminal Defense Improvements
(firmenpresse) - IRVINE, CA -- (Marketwired) -- 12/20/14 -- New York Governor Andrew Cuomo's announcement to improve criminal defense services for the state's poor, together with the New York Civil Liberties Union, has triggered discussions amongst politicians and lawyers in other states, debating how much change to the current system is necessary to achieve fair and adequate legal representation for underprivileged citizens. According to California-based expert defense attorney , the reform in New York is only a first step towards closing what he calls a "growing justice gap" and he urges other states to follow suit.
"All states are expected to provide a defense attorney pro bono if a defendant can't afford one," Cavallo explains. "But what we've seen over recent years is that tightening state budgets all too often discriminate against the poor and the underprivileged. If states lack the funds to provide adequate legal representation to indigents, they are jeopardizing the core constitutional rights of those charged with crimes."
According to the 2013 Annual Report by the Legal Services Corporation (LSC), the nation's largest funder of civil legal aid for low-income Americans, the number of Americans qualifying for legal assistance is at an all-time high. Last year, the LSC funded support for over 750,000 cases, out of which more than 10% relied on pro bono legal services.
"There's a lot of work that has to be done outside of the courtroom and if the resources aren't there, the defendants suffer the consequences," Cavallo adds. "Seeking volunteers is not the answer. States shouldn't have to rely on pro bono work or non-profit legal aid groups to fill the justice gap for those who can't afford full legal representation. The states need to revisit their fiscal budgets and responsibilities. Allowing individuals to be inadequately represented or not represented at all is unacceptable."
Aware of the lack of high-quality representation for less privileged victims, has been offering his pro bono services to abused women for many years, using his reputation as a relentless justice fighter to advocate their rights inside and outside of court. He has extensive experience representing defendants in criminal and civil trials, including high-profile felony cases. In his role as a defense attorney, Cavallo has guest appeared to provide his expert opinion on numerous network television programs, including CNN, MSNBC, and Good Morning America.
