US PTAB Denies Sophos' Petitions for Inter Partes Review of Finjan's '494 and '926 Patents; Litigation Continues With All Eight Patents

(NASDAQ: FNJN), a cybersecurity company, today announced that the Patent Trial and Appeal Board (PTAB) for the United States Patent & Trademark Office (USPTO) denied dual petitions for inter partes review (IPR) by Sophos for Finjan patents; 8,677,494 ('494 patent) "Malicious Mobile Code Runtime Monitoring System and Methods," with docket number IPR2015-01022 and 7,613,926 ('926 patent) "Method and System for Protecting a Computer and a Network from Hostile Downloadables," with docket number IPR2015-00907. The patent lawsuit filed in March of 2014 (CAND-3-14-cv-01197) against Sophos will continue with these and six other Finjan patents, as originally filed. The other six Finjan patents in the litigation include; 6,154,844, 6,804,780, 7,613,918, 7,757,289, 8,141,154, and 8,566,850.
"The PTAB's decision to deny Sophos' IPR petitions against Finjan's '494 and '926 patents, further bolsters the strength and value of our IP assets," said Finjan's Chief Intellectual Property Officer and VP of Legal, Julie Mar-Spinola. "We are confident in the merits of our patent claims against Sophos and will continue to vigorously and fairly pursue them in accordance with our licensing best practices."
In both petitions, the PTAB showed deference to recent decisions in Finjan's district court actions noting on several occasions they were not persuaded to modify definitions of claim terms as requested by Sophos nor any combinations of art references presented. The PTAB denied institution on the '494 patent noting that Sophos had not demonstrated the likelihood of prevailing in showing the unpatentability of any of the challenged claims: 1, 10, 14 and 18 of the '494 patent. Additionally, PTAB denied institution on the '926 patent noting that Sophos had not demonstrated the likelihood of prevailing in showing the unpatentability of any of the challenged claims: 15, 18, 19 and 22 of the '926 patent. As such both petitions were denied on each of the asserted grounds.
