Trend-Setting Patent Plays: SEFE Inc. (SEFE), VirnetX Holding Corp. (VHC), and InterDigital Inc. (IDCC)

(SEFE) goes about the business of assembling a patent portfolio to stake its claim in atmospheric energy, a number of patent-related developments continue to hit the market. VirnetX (VHC) has recently been in the headlines for suing a who's who in high-tech over patent infringement, including Apple (AAPL), Cisco (CSCO), and Siemens (SI) -- and there could even be more legal action in the future. InterDigital (IDCC), a wireless technology company, has put out to bid part of its intellectual property portfolio for potential buyers.
Earlier last week, SEFE provided details about its most recent patent development: the Cubic Wire Detector, categorized as a "continuation-in-part" application, which adds a variation to SEFE's patent-pending application for Collection of Atmospheric Ions while claiming priority based on the original patent, which was filed with the U.S. Patent and Trademark Office on May 12, 2011. The company currently has 26 patent applications in various stages of the application process.
In just the past few days, VHC signed a patent license agreement with Aastra USA, a telecom technology company, that allows them to use certain of their patents for an upfront payment and future royalties. Aastra agreed to settle and pay up, rather than spend years bogged down in court. This is why patent protection is essential to companies with strong patent portfolios in their respective fields.
In late April, VHC appeared to have a big win in court that could result in Apple, among others, having to pay significant settlement fees and royalties. Some experts even believe the iTitan could even be forced to buy the internet security and software company. In addition, Google (GOOG) could be next in VHC's crosshairs. On the other hand, companies that aren't currently infringing or being sued could be interested in snapping up the company's intellectual property.
Also in late April, InterDigital CFO Scott McQuilkin stated that the company is "actively marketing a modest portion of its large patent portfolio to interested parties." Whether the company is successful in shopping its technologies or instead pursues the avenue of litigation, is yet to be seen -- but it could have major implications for how intellectual property is valued and handled going forward.
High-tech patents are a high-stakes game. As SEFE continues to build its patent portfolio, it's positioning itself to benefit over the long haul.
