(firmenpresse) - SCOTTSDALE, AZ -- (Marketwire) -- 08/02/12 -- Although many of Arizona's "New" DUI Laws have been around for months, some charged with Driving Under the Influence are still not receiving the benefits. "When mounting a defense, it's necessary to stay on top of the latest Arizona DUI laws. But this year, it's taken quite some time for new legislation to be implemented and applied consistently from court to court," Schwab says. "The new laws don't just apply to the criminal courts, but also to the Motor Vehicle Department."
Arizona's law changes can reduce the interlock requirement from 12 months to 6 months in some cases. The minimum mandatory jail requirements have also been modified and even significantly reduced in certain instances. "Allegations of criminal conduct can be life altering. The government has the burden of proving an allegation, beyond a reasonable doubt, but also of making sure that the law is applied accurately, even when it benefits the accused," Schwab says.
