Final Report Dutch investigation published
(Thomson Reuters ONE) -
The final report of the Dutch investigators has been filed and is publicly
available for inspection at the offices of the Dutch Ondernemingskamer in
Amsterdam.
Following the events of September and October 2008 and at the request of two
Dutch shareholder organizations, VEB and ESG, the Dutch Ondernemingskamer
("Dutch Companies and Business Court") ordered in November 2008 an investigation
into the policy and affairs of the former Fortis N.V. during 2007 and 2008. The
report, which is only available in Dutch, has also been published on the website
of Ageas under
http://www.ageas.com/Documents/NL_final_report_dutch_investigation_20100616.pdf
In summary, the Dutch investigators were asked to investigate the acquisition of
ABN AMRO in October 2007, the publication of information by Fortis in the period
from October 2007 until October 2008 and the events in September and October
2008 which led to the sale of Fortis assets to the Dutch and Belgian governments
and BNP Paribas. The experts do not criticize the decisions taken in respect of
the acquisition of ABN AMRO. They also conclude that the events in
September/October 2008 cannot be isolated from the general financial crisis of
unprecedented proportion and that the deals with the Dutch and Belgian
governments and BNP Paribas probably were the best possible outcome under the
circumstances. The investigators however criticize the way in which the former
Fortis communicated on certain occasions in the intermediate period.
Ageas welcomes the report as a step forward in removing part of the uncertainty
relating to the events that occurred in 2007 and 2008. Ageas will incorporate
the findings of the report in its management of the Fortis legacy so as to
protect the best interests of its shareholders, but will for the time being
refrain from further public comments.
