Time Limits for Personal Injury Claims

However, you must be aware that there are time limits to abide to. It is essential that you should not hesitate to seek legal advice from before it is too late.
Time Limits
You will have three years to make a claim, starting from the date of the accident or in certain cases three years from the date of knowledge i.e the date you became aware of your injury. However a whiplash injury usually appears from the outset of the accident.
If you were under the age of 18 at the time of the accident, you will have three years from the date of your 18th birthday. This means you will have until your twenty-first birthday to make a claim.
What happens if I'm too late to claim?
If the three years have passed and you have not made a claim, you will not be able to proceed to make a claim. If you are nearly at the three year mark, you may also find it hard to secure a solicitor who will take your claim on. That is why it is essential that you should not hesitate to seek early advice and before it's too late.
Time Limits do not apply to:
Those who are unable to manage their own legal affairs because of a mental incapacity.
Time Limits outside England and Wales
There are different time limits for accidents occurring outside England and Wales and the legal procedures can vary from country to country. In many countries, the limit is shorter than three years and it is therefore imperative that you do not hesitate to seek legal advice as soon as the accident has occurred.
