It was assigned to Department Number 13 and it was given a case number of A-13-677023-CThe case was filed on behalf of an individual male plaintiff and it was filed against Heights of Summerlin LLC. The theory behind the case was that the defendant facility negligently failed to provide a reasonable level of care to the plaintiff such that he allegedly developed a bedsore because of this negligence.
According to the court documents, the plaintiff was living at the defendant facility when he developed a severe bedsore in the area of his buttocks. The documents went on to allege that this bedsore developed because the plaintiff was not properly turned and moved at regular intervals, and that such regular movement would have prevented the development of this medical problem. As a result of the development of this bedsore, the plaintiff was required to undergo a series of long-term medical treatments in order to bring it under control.
The court documents went on to allege that the defendant nursing home was negligent in that it failed to meet its legal duty by preventing the plaintiff from encountering an unreasonable risk of harm, that this failure to properly manage the plaintiff's movements is what caused the bedsore to develop and that as a result of this alleged failure, the plaintiff encountered several different forms of loss that include medical costs and pain and suffering. The lawsuit is currently active within the Nevada court system and it seeks an unspecified amount of damages that will be proven at trial.
