The New York Times draws from information from the National Practitioner Data Bank, which records actions taken by state licensing boards against doctors and physicians. According to this data, close to 29 percent of all malpractice payments are made for diagnostic errors.
Second on the list are errors related to treatment and surgery. In third place is "all other errors combined," which include medication issues, monitoring problems, obstetric blunders, and more. All of these combined account for just 20 percent of all malpractice payments.
Also noted in the article is the fact that errors in diagnosis account "for 33.8 percent of the disabilities and almost 40 percent of the deaths that resulted in malpractice payments."
According to Boonswang, these statistics are alarming, but they also suggest actions that patients can take to lessen the likelihood of medical neglect. "The best thing that you, as a patient, can do is to become your own healthcare advocate," he advises. "Study up on the diagnosis that you are provided with, and ask any questions that may arise. Be active and aggressive in ensuring that you understand what your doctor is saying, and that you have a voice and a vote in your own medical treatment."
Chad Boonswang says the best way to avoid victimization to medical malpractice is simply this: "Don't be intimidated, but rather, assert yourself during the diagnosis process."
