The lawsuit at issue was filed in the District Court of Clark County, Nevada. The case was sent to Department Number X and it was assigned a case number of A-10-631349-C. The named plaintiff in the case was an individual female who was allegedly injured as a result of the negligence of the named defendant in the case, which was a retirement home that operates within the borders of Clark County. The case sought damages based on an incident that was described in the documents filed in furtherance of the case.
According to those court documents, the plaintiff was a resident at the defendant nursing home when she slipped and fell on that premises. As a result of this fall, the plaintiff was seriously injured and suffered, among other things, a broken hip. This injury required ongoing medical care and treatment as well as a protocol of medication and oversight. The injury also allegedly led to a prolonged period of excruciating pain for the plaintiff.
The attorneys at Bernstein & Poisson argued in the court documents that the defendant nursing home was negligent because it failed to properly monitor the plaintiff such that she was supposed to have been protected from these falls. The documents went on to assert that because of this lack of oversight, the plaintiff did in fact fall and suffer serious injuries that caused her to incur losses relating to medical costs and pain and suffering.
Rather than fully litigate the matter, the two sides were able to come together and negotiate a settlement. As part of the settlement agreement that was executed between the parties, a confidentiality clause was included that prevents anyone involved with the case from disclosing the identity of the parties or the specific amounts involved with the settlement. In furtherance of this agreement, the Las Vegas nursing home lawyers at Bernstein & Poisson dismissed the matter and the case is now closed.
