OLG Duesseldorf pronounced the first judgments on data cost
reclamation claims: Deutsche Telekom has to repay approx. EUR 45 m -
telegate expects a positive upcoming pronouncement of the judgment on
the action of EUR 52.04 m

Today, the first judgments were pronounced in a long-standing legal dispute
of telegate AG as well as its subsidiaries datagate GmbH and telegate MEDIA
AG against Deutsche Telekom AG concerning improperly excessive costs of
provision of subscriber data (cp. today's special announcement release). In
this case, the Higher Regional Court (OLG) Duesseldorf ordered Deutsche
Telekom AG in two actions of datagate GmbH (Court's reference number VI U
1/11) and telegate MEDIA AG (Court's reference number VI U 6/11) to repay
EUR 33.63 m. In addition to the repayment of data costs, interest payable
as from commencement of proceedings has to be added in the amount of EUR
approx. 11.5 m. The right to appeal was not granted by the OLG. The reasons
given by the OLG are not available yet.
Dr. Andreas Albath, telegate AG's CEO, comments on today's judgments: 'A
milestone is set today in the long-standing legal dispute with Deutsche
Telekom. Even though judgments are not final yet and the pronouncement of a
judgment on our biggest action was postponed, we are just before the
finishing line. This is based on the fact that the Higher Regional Court
Duesseldorf already passed a judgment in our favour for the second time
now. Thus, we would expect a rather positive judgment on telegate AG's
pending action of EUR 52 m. The pronouncement includes further interest
payable as from commencement of proceedings and had to be postponed to May
18, 2011, due to illness of a judge at the OLG Duesseldorf.'
Subject to a success in this remaining action, the company expects another
inflow of liquidity in the amount of approx. EUR 60 m from the claim for
repayment actions as well as taking an advance payment by Deutsche Telekom
AG, which was already made, and a tax expenditure into account.
About the history of proceedings: the OLG Duesseldorf made judgments in the
same proceedings in favour of telegate already in 2007. The judgments were
overruled by the Federal High Court of Justice in 2009 and remitted to the
OLG Duesseldorf for further court hearing. As a result, today's judgments
were given.
