Giganews Scores Complete Legal Victory Over Perfect 10, Sets Important Copyright Precedents
Judges Dismiss Perfect 10's Direct and Indirect Copyright Infringement Claims Against the Usenet Provider
(firmenpresse) - AUSTIN, TX -- (Marketwired) -- 11/18/14 -- Giganews, the world's premium Usenet access provider, announced today the United States District Court for the Central District of California has granted Giganews a complete victory in its long-running legal battle with Perfect 10.
On Friday, the court granted Giganews a series of summary judgment decisions on the various copyright claims in the case, rejecting all the different theories and claims that Perfect 10 had asserted. The rulings followed extensive discovery and fact finding by the parties.
"These decisions and final rulings underscore the fact that Giganews has always acted responsibly and appropriately to work with copyright holders. We're proud to have stood up against these baseless claims and to have stayed the course in defending against Perfect 10," said Ron Yokubaitis, co-Founder of Giganews. "Over the course of the case, three different federal judges issued key rulings in Giganews' favor."
The court had previously dismissed Perfect 10's allegations of trademark infringement, publicity rights violations, and unfair competition. The court also earlier specifically ruled that Perfect 10 had not shown fault in Giganews' process of handling notifications of claimed infringements or Giganews' repeat infringer termination policy.
