It is our policy and firm commitment to properly deal with issues from the past
and update the market in line with regulatory requirements. In this context we
inform you on the following cases.
Germany: competition law violation not confirmed
With reference to the press release of November 6th, 2014 Imtech can provide an
update regarding a possible violation of competition law in Germany in the
period 2008-2010. The internal investigation, conducted by our GRC (Governance,
Risk and Compliance) department, assisted by external counsel and experts, has
not confirmed that competition laws were violated.
Poland: unrealistic claim
The claim reported in the media in Poland was submitted by PBG, a Polish company
in liquidation. The claim relates to a project, a football stadium, which was
finished in 2012. Imtech itself filed a civil claim against PBG in 2013 in
regards to this project. PBG has now responded by submitting a counter claim of
about 130 million euro. The claim is deemed unrealistic in substance, size and
timing.
United Arab Emirates: initial investigation
Imtech has initiated an investigation into certain sales activities by an Imtech
Marine entity in the United Arab Emirates in relation to potential violations of
applicable export controls and sanctions regulations. The investigation is
conducted by external counsel and experts. Imtech has disclosed the fact that it
has initiated the investigation to the appropriate authorities.
Imtech emphasizes that at this point it is too early to draw definite
conclusions or make any definite statements. Imtech will provide an update if
and when applicable.
The Imtech Marine entity in the United Arab Emirates is a unit with annual
revenue of around 15 million euro. The initial investigations indicate that
potential violations relate to a relatively small percentage of this revenue.
