Federal Appeals Court Determines That the Processing System Introduced by Stored Value Solutions in 1996 and 1997 Invalidates Two Alexsam, Inc. Patents

(firmenpresse) - LOUISVILLE, KY -- (Marketwired) -- 08/10/15 -- Over the past decade, Alexsam, Inc. has asserted numerous gift card merchants infringe its two U.S. patents. While non-SVS merchants have settled cases with Alexsam for undisclosed amounts, SVS was aggressive in supporting its clients' cases and helped develop strong defenses of the SVS system. Three of these cases resulted in jury verdicts of no infringement, which verdicts were validated by a 2013 appeals court decision. Two additional cases against SVS customers were dismissed outright by Alexsam after this series of trial defeats in the Eastern District of Texas.

On June 16, 2015, the United States Court of Appeals for the Federal Circuit issued a decision invalidating both Alexsam patents based on an SVS prior art system implemented in the mid-1990s. SVS witness trial testimony was essential to this decision and prominently featured in the Federal Circuit's opinion.

This Federal Circuit decision now confirms our long-held belief that the Alexsam patents are also invalid and notably that SVS's own prior art system predates the invention claimed in the Alexsam patents.
