$3.35 Million Recovered for Accident Victim Rear Ended by Distracted 18-Wheeler Driver

On Christmas Eve, December 24th, 2012, Thomas East was driving his pickup truck westbound on Interstate 410 in San Antonio, Texas when he was suddenly struck from behind by Oakley Trucking driver David Henefield. Mr. Henefield was dialing on his cell phone at the time of the crash, and had made eight calls and received one in the 15 minutes leading up to the crash. As a result of the collision, Mr. East's truck flipped off the roadway, causing him to suffer a mild as well as in both his neck and back.

At mediation, Oakley Trucking refused to offer more than $1 million in settlement. Zehl rejected the offer and continued preparing the case for trial. Several days before jury selection, the company tripled its settlement offer to $3.35 million.
The settlement is the largest recorded recovery in Oakley's history, making this the fourth consecutive case in which the attorneys at Zehl & Associates have obtained the largest recovery in a company's corporate history. The case is Thomas East v. Oakley Trucking, Inc., et al., 2013-CI-03238 in the 73rd District Court of Bexar County, Texas.
