Telenor will not block The Pirate Bay

(Thomson Reuters ONE) - (Fornebu, 6 November 2009) The Asker and Bærum District Court todaydelivered its verdict on the so-called Pirate Bay case. The Courtconcludes that Telenor is not illegally contributing to any violationof copyrights through services offered by The Pirate Bay and thatthere is subsequently no basis for instructing Telenor to blockadmission to the website.Obviously we are pleased that the District Court has arrived at thisconclusion. At the same time it is important for us to emphasise thatthis case is not about being in favour of or opposed to copyright,but about whether or not it is reasonable to saddle Internet serviceproviders to with a censorship role in respect of content on theInternet. We have always thought that the answer to this should be"no" and we are now happy to note that the court shares our views onthis subject. We and copyright owners can now continue our work tofind good and profitable solutions for legal content sharing," saysHead of Telenor Norway Ragnar Kårhus.Telenor believes that the most important way of maintaining healthyrevenues among intellectual rights holders, is to develop businessmodels and services that make websites like The Pirate Bay lessattractive. New music services like the online music store Wimp,which Telenor is currently testing, help create viable businessmodels for digital downloads that ensure that artists receivepayment."This is the way to go, rather than ordering Internet serviceproviders to censor the Internet", says Mr. Kårhus.Apart from focusing on the fact that Telenor, through its behaviourcan not be said to have acted in unlawful ways, the court, in itsruling, also focuses on the potential negative consequences it mayhave if Telenor and other Internet providers are ordered to blockaccess to websites that allegedly are engaged in illegal activities.On this, the court states the following:"As a result, Telenor andother Internet providers, including private companies, may have to doan evaluation on whether an Internet page or service shall be blockedor not.
