Align Technology Provides Update Regarding Patent Case Against ClearCorrect

(NASDAQ: ALGN) today provided an update regarding the International Trade Commission (ITC) release issued on July 25, 2013 stating that it has decided to review the Administrative Law Judge (ALJ) Rogers' final Initial Determination (ID), which was issued back on May 6, 2013.
Commenting on the ITC release yesterday, Roger E. George, Align Technology vice president corporate and legal affairs and general counsel said, "The ITC yesterday announced that it will review the Administrative Law Judge's finding that ClearCorrect violated Section 337 by infringing Align's valid patents. In recent years, the ITC has reviewed almost every Initial Determination finding a violation of Section 337 in a contested matter, so the decision by the Commission to review the judge's determination that ClearCorrect infringes 37 valid claims from 6 different Align patents is neither unexpected nor remarkable. The Commission's final determination will be made by late September 2013. Align fully expects the Commission to adopt the findings of validity and infringement by ClearCorrect contained in the Administrative Law Judge's 816-page ruling and impose the remedies recommended by the judge, including a cease and desist order preventing ClearCorrect from importing its infringing digital treatment plans and other digital data from the former OrthoClear employees who now work for ClearCorrect in Pakistan."
