Companies rely on professional project management to resolve disputes
Munich, 16 March. Companies must increasingly rely on creative and
individual solutions and must build-up conflict management systems to
resolve disputes. This is the conclusion of the participants at the Noerr
Litigation Conference 'Rethinking Disputes', an international meeting of
experts from business and law.
Whether a national or international dispute is resolved before a state
court, by arbitration or mediation, is, according to the experts,
increasingly also a commercial question. Prolonged and expensive litigation
before state courts in particular is a problem for businesses. 'An
integrated conflict management approach is therefore necessary', said
Michael Molitoris, head of the Litigation Department at Noerr. Potential
conflicts with customers and suppliers should be recognised and tackled in
advance - requiring precise analysis of the processes in each department of
the group. 'Above all, however, the knowledge gained is helpful when the
best resolution technique is being selected when a real conflict arises'
said Molitoris.
Specialised litigation departments must develop standards to enable them to
identify for their clients on objective criteria the most efficient
approach to the resolution of each dispute. Based thereon, an individual
dispute strategy can then be decided on, taking account of the means and
the selection of the appropriate forum (Forum Shopping), alternative
dispute resolution (ADR), fast track arbitration, crisis PR and - if
necessary - court proceedings.
'Professional project management in litigation requires more than replacing
adversary proceedings by alternative methods of dispute resolution',
emphasised Molitors. In the discussion about the Mediation Act and the
efforts of the EU Commission to promote alternative dispute resolution
mechanisms, it is easily forgotten that arbitration and mediation are not
panaceas but additional options besides contentious proceedings. The
individual resolution of conflicts on the other hand opens a major
potential saving for cost conscious companies which are subject to short
interval reporting obligations.
